Terms of use

The terms that apply to using Cow, ordering video messages and working as a creator. Please read them carefully: they bind you from the moment you use the service.

1. General

1.1. These terms are a binding agreement between you and the operator of Cow at cow.co.il, whose details appear at the bottom of this page ("Cow" or "we"). They apply to every use of the site and our services. 1.2. The privacy policy and the cookie policy form part of these terms. 1.3. Signing up, ordering a video or opening a creator profile requires accepting these terms. If you do not accept them, please do not use the service. 1.4. If the Hebrew version and a translation differ, the Hebrew version prevails. 1.5. Nothing in these terms limits any right you have under law that cannot be waived, including under the Consumer Protection Law, 5741-1981. A term that contradicts such a provision is void, and the rest remain in force.

2. Definitions

2.1. "User": anyone who uses the site, signed up or not. 2.2. "Buyer": a user who orders a video. 2.3. "Creator": a user who opened a creator profile, was approved by us, and records videos for payment. 2.4. "Video": a personal video message a creator records to order, including any note attached to it. 2.5. "Order": a buyer's request for a video from a specific creator, paid by card when placed. 2.6. "Delivery deadline": the latest time for delivering the video, as shown before payment. 2.7. "Payment processor": the licensed card processor that handles payments and refunds (Grow, formerly Meshulam). 2.8. "Earnings": the creator's share of the price of delivered orders, after our fee, as shown in the studio.

3. Age limits

3.1. You can open an account from age 13. Anyone under 13 may not use the service. If we learn that such an account was opened, we will close it and delete its data. 3.2. Users aged 13 to 17 may use the site only with a parent's or guardian's consent, and the parent or guardian is responsible for their use of the site. 3.3. Only people aged 18 or over may order and pay for a video. A teenager who wants a video can ask a parent to order it from the parent's own account. Before paying, the buyer declares that they are 18 or over and are paying with their own card or with the card holder's consent. 3.4. Opening a creator profile, receiving payment and withdrawing money are allowed only from age 18, as set out in section 9. 3.5. The age limits rely on your declarations at sign-up, at payment and when opening a creator profile. We may ask for proof of age or identity and suspend an account until it is provided. 3.6. Giving a false age is a fundamental breach of these terms, and we may close the account for it. 3.7. The age limits follow, among others, the Legal Capacity and Guardianship Law, 5722-1962, and the Youth Employment Law, 5713-1953.

4. Your account

4.1. Give accurate and complete details when signing up, and keep them up to date. You may not open an account in someone else's name. 4.2. Your account is personal. You may not transfer, sell or share it. 4.3. You are responsible for keeping your password and sign-in methods safe, and for everything done in your account. If you suspect unauthorised use, write to us at once. 4.4. We may refuse, suspend or close an account for a reasonable cause, such as a breach of these terms, suspected fraud, or a demand by a competent authority. 4.5. You can ask at any time to close your account and delete its data, as set out in section 17 and in the privacy policy.

5. The service

5.1. On Cow you order personal video messages from content creators. You order from and pay us; we pass the order to the creator you chose and pay them for the recording after the video is delivered. 5.2. Creators are real people who work with us as independent service providers, not as our employees. Every creator undertakes to record each video personally, in their own voice and appearance, without artificial intelligence and without anyone else in their place (section 9.4). 5.3. The wording, style and delivery of the video are the creator's, based on your request, and we do not guarantee any particular content. We do guarantee that if the video is not delivered by the deadline, or the order is cancelled in one of the cases in section 8, you get all your money back. 5.4. We may change, add or discontinue site features without affecting orders already paid for.

6. Ordering a video

6.1. Before you pay you are shown the creator's name, your request, the total price, the delivery deadline and the cancellation terms. 6.2. Payment is made by credit card when you order, in a single payment, through the payment processor. The creator receives their share only after the video is delivered. 6.3. Every request is screened automatically before it reaches the creator. A request that breaks the content rules is blocked, and you are not charged for it. 6.4. The creator may accept or decline the order without giving a reason. 6.5. After payment we send you an order confirmation with the order details, price, delivery deadline and cancellation terms. Progress updates appear on the "My orders" page and in notifications. 6.6. The video is delivered on the order page, where you can watch and download it. It stays there for as long as your account is active. 6.7. The video is recorded specifically from the details you gave. Wrong or missing details are your responsibility and do not give a right to cancel after the creator has accepted the order.

7. Prices and payment

7.1. Prices are in new Israeli shekels and are the final price you pay. There are no fees or extras beyond the price shown before you confirm the order. 7.2. The site's operator is registered as an exempt dealer (osek patur), so no VAT is charged. You receive a receipt for every payment. 7.3. Payment is by credit card, in a single payment only. 7.4. There is no wallet, balance, coins or credit on the site. Each order is paid separately. 7.5. We do not see or store full card details. They go directly to the payment processor, and payment is also subject to its terms. 7.6. Creators may change their prices and we may change our fee. Such a change does not apply to an order already paid for.

8. Cancellations and refunds

8.1. This section sets out your rights under the Consumer Protection Law, 5741-1981, and the Consumer Protection (Cancellation of Transaction) Regulations, 5771-2010, and our own commitments that go beyond them. 8.2. Before the creator accepts: as long as the creator has not accepted the order, you can cancel it on the "My orders" page and get the full amount back, with no cancellation fee. 8.3. After the creator accepts: the video is recorded specifically for you from the details you gave. Therefore, under section 14C(d) of the Consumer Protection Law and regulation 6 of the Cancellation Regulations, the distance-sale cancellation right does not apply once the creator has accepted the order. 8.4. Automatic full refund: in each of the following cases the order is cancelled and you get the full amount back without asking: the creator declined; you cancelled before the creator accepted; the video was not delivered by the deadline; or support cancelled the order. 8.5. A video that does not match the request: if the delivered video differs materially from what you asked for (for example the wrong recipient name, a different occasion, or a broken file), or it breaks the content rules, write to us within 14 days of delivery. We will review it, and if the complaint is justified we will refund the full amount. 8.6. Every refund goes to the card you paid with, no later than 14 days after the cancellation. When the credit appears on your statement depends on your card issuer. 8.7. We do not charge cancellation fees. 8.8. You can give notice of cancellation on the "My orders" page or by email to support@cow.co.il. 8.9. A person with a disability, a senior citizen or a new immigrant may, under the conditions of section 14C1 of the Law, cancel within four months a distance sale that included a conversation with the dealer. Orders on the site are placed without a conversation, so the section usually does not apply to them.

9. Creators

9.1. Only people aged 18 or over may open a creator profile. A profile goes live only after we approve it. 9.2. Before approving a profile, and in any case before the first withdrawal, we will ask to verify identity and age. The bank account for withdrawals must be in the creator's own name. 9.3. The creator sets their price and delivery time and undertakes to meet them. 9.4. The creator undertakes to record every video personally, appearing in it in their own voice and appearance. It is forbidden to use artificial intelligence to create or alter a face, likeness or voice, to use deepfakes or voice cloning, or to have anyone else record in the creator's place. Breaching this section is a fundamental breach: we will remove the video, refund the buyer in full, and may withhold payment and close the profile. 9.5. The creator may decline any order for any reason. Declining quickly is better than letting an order expire. 9.6. A creator may not ask a buyer for contact details, payment or a meeting outside the site. 9.7. Fee: our fee, at the rate shown in the studio when the order is placed, is deducted from the price of each order. The creator's share is credited to their earnings after the video is delivered and the payment has been received. 9.8. Withdrawal: earnings above the minimum shown in the studio can be withdrawn to an Israeli bank account in the creator's name. For every payment a creator receives from us, they issue us a valid receipt or invoice, and we may hold a withdrawal until it arrives. 9.9. The creator is an independent service provider. There is no employment relationship between us, and we do not pay wages, pension, holiday pay or severance for them. 9.10. The creator alone is responsible for reporting their income, registering as a dealer where the law requires it, and paying income tax, VAT (if it applies to them) and National Insurance. If the law requires us to withhold tax at source, we will, unless the creator provides an exemption or reduced-rate certificate. 9.11. We may hold a payment where there is reasonable suspicion of fraud, a breach of these terms, or repeated complaints, or at the demand of a competent authority. We may set off against earnings any amounts refunded to buyers because of the creator's breach. 9.12. Giving a false age or identity leads to the profile being closed and open orders cancelled, with full refunds to buyers. Accumulated earnings are frozen pending review. 9.13. Earnings not withdrawn stay in the creator's studio account, with no management fee.

10. Rights in the video and how you may use it

10.1. The copyright in the video belongs to the creator. This applies also to a video ordered for a private or family event, notwithstanding section 35(b) of the Copyright Act, 5768-2007. 10.2. On delivery, the buyer receives a personal, non-exclusive licence, unlimited in time, to watch, keep and share the video for personal, non-commercial use, including on the buyer's personal social media accounts and by sending it to the recipient. 10.3. The licence does not allow commercial, advertising or marketing use, selling or distributing it for payment, or editing that changes the meaning of what was said or attributes to the creator something they did not say. The creator's moral rights are preserved. 10.4. The creator grants us a licence to store, process and deliver the video to the buyer, and to view it to handle complaints and keep the service safe. 10.5. The video is shown on the creator's public profile or in the feed only if the buyer allowed it when ordering. A buyer who allows it confirms they have the consent of anyone who appears or is mentioned in it and, if the recipient is a minor, the consent of a parent or guardian. You can withdraw this permission at any time by writing to us, and we will remove the video from display within a reasonable time. 10.6. The site's logo, design, code and content, other than content uploaded by users, belong to us. You may not copy or use them without written permission.

11. Content rules

11.1. You may not order, record, upload or publish content that is abusive, threatening, harassing or humiliating; that incites violence, racism or terrorism; that is defamatory under the Prohibition of Defamation Law, 5725-1965; or that encourages illegal activity, drug use, gambling or drinking by minors. 11.2. Sexual content of any kind is forbidden, and any sexual content involving minors is absolutely forbidden. 11.3. You may not invade anyone's privacy, including publishing their address, phone number, personal details or pictures without consent. 11.4. You may not ask a creator to impersonate another person, or use another person's name, image or voice without their consent. 11.5. You may not order a video to advertise, market or promote a business, product or service. 11.6. You may not infringe copyright, trademarks or other intellectual property rights. 11.7. You may not pass on contact details, offer payment outside the site or ask to meet. 11.8. The buyer is responsible for being allowed to share the details written in the request, including other people's names and details. Do not include sensitive information, such as health, sexual orientation or criminal record, in a request. 11.9. Roasts: a roast on the site is friendly humour, the kind the recipient laughs at themselves. A roast may not include mockery of appearance, body, weight, disability, illness, origin, religion, gender or sexual orientation; humiliation or bullying; revealing a secret or personal information; sexual content; or a hurtful factual claim that could be defamatory. When the recipient is a minor, only gentle humour is allowed, with no jabs at their body, looks, school or friends. A buyer who orders a roast declares that the recipient will take it in good spirit. Every roast request is also reviewed by a person on our team, and the creator may decline it or record a gentler version. The buyer is responsible for the content of their request, as set out in section 11.8.

12. Reports, screening and takedowns

12.1. Every request, post and comment is screened automatically. Content that breaks the rules is blocked or flagged for review. 12.2. You can report a profile, post or comment with the report button next to it, or by email to support@cow.co.il. Every report is reviewed by a person, and reports of harm to minors or immediate danger are reviewed first. 12.3. If you believe content on the site infringes your rights, for example copyright, privacy or reputation, write to hello@cow.co.il with a link to the content and an explanation. If the complaint is well founded, we will remove or restrict the content and tell whoever posted it. They may respond, and if the removal turns out to be unjustified, we will restore the content. 12.4. We may remove content, or suspend or close an account, where there is reasonable suspicion of a breach of these terms or the law. Removed content is kept for a limited time so the decision can be appealed. 12.5. If a buyer's account is closed, an undelivered order is cancelled and refunded as set out in section 8. A creator's earnings not yet withdrawn are handled under section 9, unless the law prevents it.

13. Privacy

13.1. Your personal data is handled under the privacy policy, which forms part of these terms. It explains what we collect, why, who receives it, how long it is kept and how to exercise your rights.

14. Liability

14.1. We work to keep the site running smoothly and without faults, but cannot guarantee it. 14.2. If something goes wrong with an order, the main remedy is the refund in section 8. To the extent the law allows, our liability for a particular order is limited to the amount you paid for it, and we are not liable for indirect or consequential damage. 14.3. The limits in this section do not apply to damage caused wilfully or by gross negligence, and do not limit any right you have under law that cannot be waived.

15. Indemnity

15.1. If you breach these terms or infringe someone else's rights through the site, and a claim or demand is made against us as a result, you will indemnify us for the damage and reasonable costs caused. We will tell you about any such demand and let you defend against it.

16. Changes to these terms

16.1. We may update these terms from time to time. Every version is dated. 16.2. We will give at least 14 days' notice of a material change, on the site and by email. It applies only from when it takes effect, and not to orders paid for before then. 16.3. If you do not accept a change, you can stop using the service and ask to close your account. If you keep using the service after the change takes effect, it applies to you. 16.4. We keep the version you accepted, so a later update does not retroactively change what you agreed to.

17. Closing your account

17.1. You can ask at any time to close your account by emailing privacy@cow.co.il from the address registered to the account. 17.2. Closing the account does not cancel an order the creator has already accepted, and does not affect rights and obligations that arose before it closed. 17.3. After closing, we keep only the data the law requires us to keep, as set out in the privacy policy.

18. Governing law and jurisdiction

18.1. These terms and the use of the site are governed by the laws of the State of Israel. 18.2. Jurisdiction lies with the competent court under Israeli law. This does not limit your right to file a claim in the small claims court.

19. General

19.1. Notices from us are sent to the email address registered to your account. 19.2. You may not transfer your rights under these terms without our consent. We may transfer the service and our rights to another body, provided your rights are not harmed. 19.3. Not enforcing a right is not a waiver of it. 19.4. If a term is found void, the rest remain in force. 19.5. These terms, together with the privacy policy and the cookie policy, are the entire agreement between us on this subject.

20. Operator details and contact

20.1. The site's operator is an exempt dealer. Their name, dealer number and address appear at the bottom of this page, as required by section 14C of the Consumer Protection Law. 20.2.
